First Offense Penalties for DWI or DUI in New Jersey

DWI penalties are dependent on the Blood Alcohol Content (BAC) of the driver at the time of the arrest.For first time offenders, there is a tier of levels under which the penalties will be considered.

  • BAC of .08 but less than .10 or no BAC readings = 3 months loss of license
  • BAC of .10 or higher= 7 months to 1 year loss of license
  • A fine of $250-$400 may also be imposed

Second Offense Penalties for DWI or DUI in New Jersey

A second offense in New Jersey could mandate a two year suspension of your New Jersey Driver’s License.

A person who operates a motor vehicle with a blood alcohol concentration of 0.08% or more or who permits another person with a blood alcohol concentration of 0.08% or more to operate a vehicle owned by him or when in his custody shall be subject to:

  • A fine of $500 to $1,000
  • 30 days of community service
  • 48 hours to 90 days of a prison term
  • Revocation of his or her driver’s license for a term of 2 years
  • Installation of an ignition interlock device in his or her vehicle
  • Revocation of registration certificate and registration plates (if license is not revoked) for a period of 2 years

Third or Subsequent Offense Penalties for DWI or DUI in New Jersey

A third conviction for DWI or DUI in New Jersey carries a ten year loss of license and possibly a permanent loss of your New Jersey Driver’s License as well as a lengthy prison sentence and alcohol rehab program.

A person who operates a motor vehicle with a blood alcohol concentration of 0.08% or more or who permits another person with a blood alcohol concentration of 0.08% or more to operate a vehicle owned by him or when in his custody shall be subject to:

  • A fine of $1,000
  • 180 days in a county jail or workhouse
  • Revocation of driver’s license for a period of 10 years
  • Installation of an ignition interlock device in his or her vehicle
  • Revocation of registration certificate and registration plates (if license is not revoked) for a period of 10 years
